  • NOT a replacement for consulting with qualified healthcare professionals
  • NOT intended to treat, cure, or prevent any disease or medical condition

2A. AI-POWERED INFORMATION CHATBOT - CRITICAL DISCLAIMERS

READ THIS CAREFULLY BEFORE USING THE AI CHATBOT

2A.1 What the AI Chatbot Provides

PainApp includes an AI-powered chatbot that provides general medical and health INFORMATION using Large Language Model (LLM) technology. This is educational content sharing, not medical advice.

Think of it like:

  • A health encyclopedia that can answer questions
  • Wikipedia for pain and neuroplasticity topics
  • A textbook you can have a conversation with
  • General health information you'd find in public resources

Not like:

  • A doctor giving you personalized medical advice
  • A diagnosis based on your specific symptoms
  • A treatment plan designed for you
  • Professional medical consultation

2A.2 Critical Difference: Information vs. Advice

INFORMATION = General knowledge about health topics

ADVICE = Personal recommendations for YOUR situation

PainApp chatbot provides INFORMATION only, never ADVICE.

2A.3 AI Technology - How It Works and Its Limitations

The chatbot uses Large Language Models (LLMs) - artificial intelligence trained on vast amounts of text to generate human-like responses.

We may use any of these AI providers:

  • OpenAI (GPT-4, GPT-3.5, future models)
  • Anthropic (Claude models)
  • Google (Gemini, PaLM models)
  • Meta (Llama models)
  • Any other LLM provider we choose
  • Multiple models simultaneously
  • We may switch providers without notice

How LLMs Actually Work:

LLMs predict the next most likely words based on patterns in training data. They do NOT:

  • Actually "understand" medicine
  • Have medical training or credentials
  • Access current medical databases in real-time
  • Know YOUR specific medical situation
  • Consult with doctors before responding
  • Verify information before generating responses

They are language prediction engines, not medical experts.

2A.4 Known AI Limitations and Risks - MUST READ

AI "HALLUCINATIONS":

LLMs frequently generate false information that sounds completely convincing. This is called "hallucination" and it's a KNOWN, COMMON problem.

The AI may:

  • Invent medical "facts" that don't exist
  • Cite studies that were never published
  • Confidently state wrong information
  • Mix true and false information together
  • Contradict itself in different conversations
  • Sound 100% certain about incorrect information

2A.5 Absolute User Responsibility

BY USING THE AI CHATBOT, YOU ACCEPT THAT:

  • You understand this is INFORMATION, not medical advice
  • ALL information could be completely wrong
  • AI frequently makes confident errors ("hallucinations")
  • You are 100% responsible for verifying any information
  • You will consult real healthcare professionals for medical decisions
  • You will NOT rely on AI responses for health decisions
  • You accept all risks of using AI-generated information

YOUR OBLIGATIONS:

ALWAYS:

  • Verify any health information with qualified doctors
  • Consult healthcare professionals before making medical decisions
  • Treat chatbot responses as unverified, potentially incorrect information
  • Seek immediate medical attention for emergencies
  • Use your own judgment about your health

NEVER:

  • Use the chatbot for medical emergencies (call emergency services immediately)
  • Follow chatbot information without professional medical consultation
  • Self-diagnose based on chatbot responses
  • Change medications, treatments, or medical plans based on chatbot
  • Delay seeking professional medical care based on chatbot responses
  • Assume chatbot information is accurate or complete
  • Trust that chatbot "understands" your specific situation

2A.6 When to Ignore the Chatbot Completely

Immediately disregard chatbot and seek medical help if:

  • You have a medical emergency
  • You experience severe or worsening symptoms
  • Chatbot information contradicts your doctor's advice
  • You have ANY doubt about the information
  • The response seems wrong or confusing
  • You're considering stopping or starting medications
  • You're making any significant health decision

IN EMERGENCIES:

  • Call emergency services (112 in EU, 911 in US)
  • Go to emergency room
  • Contact your doctor immediately
  • DO NOT waste time asking the chatbot

2A.7 No Verification or Oversight

WE DO NOT:

  • Review or verify chatbot responses before they're shown to you
  • Have medical professionals supervise the AI
  • Fact-check AI-generated information
  • Guarantee accuracy of any information provided
  • Monitor conversations for medical errors
  • Filter out incorrect medical information
  • Test responses for medical accuracy

The chatbot responds in real-time with ZERO medical oversight.

2A.12 Your Acknowledgment

By using the AI chatbot feature, you explicitly acknowledge and agree that:

  1. The AI provides INFORMATION, not personalized medical ADVICE
  2. All AI responses could be incorrect, including "hallucinated" false information
  3. AI has no medical training, credentials, or oversight
  4. You are 100% responsible for all health decisions
  5. You will verify any information with qualified healthcare professionals
  6. You will not rely on AI responses for medical decisions
  7. We have ZERO liability for AI-provided information or your use of it
  8. You use the chatbot entirely at your own risk

If you do not accept these terms, do not use the chatbot feature.

PainApp does not provide medical advice. All content, features, and functionality are for informational purposes only. No doctor-patient relationship is created by using this Service.

3.2 Consult Healthcare Professionals

  • NEVER disregard professional medical advice or delay seeking it because of something you read or tracked in PainApp
  • ALWAYS call emergency services immediately if you think you have a medical emergency

3.3 User Responsibility

You are solely responsible for:

  • Following treatment plans prescribed by your healthcare providers
  • Understanding that self-diagnosis and self-treatment can be dangerous

4. User Eligibility and Account

4.1 Age Requirements

You must be at least 18 years old to use PainApp. By using the Service, you represent that you are at least 18 years of age.

4.2 Account Registration

  • You may need to create an account to access certain features
  • You must provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

10.4 NO REFUNDS - INFORMATION PRODUCT POLICY

Important: All sales are final. No refunds.

PainApp is an information and education product, similar to purchasing a book, course, or educational material. Once you have accessed the content, tracking features, or educational materials:

  • No refunds will be provided for any reason
  • No refunds for dissatisfaction with content
  • No refunds for change of mind
  • No refunds for unused portions of subscription
  • No refunds if you don't like the educational material
  • No refunds if you don't achieve desired health outcomes
  • No refunds if the product doesn't work for you
  • No refunds if you stop using the Service

Why No Refunds:

Just as a bookstore does not refund a book after you've read it, or a course provider doesn't refund after you've accessed educational content, PainApp cannot provide refunds once you have accessed our pain tracking tools and neuroplasticity education content.

By subscribing, you acknowledge that:

  • You understand this is an educational/informational product
  • You have reviewed the features and content descriptions
  • You accept all sales are final
  • You waive any right to refunds or chargebacks

11. Disclaimer of Warranties

To the maximum extent permitted by law:

PainApp is provided as an educational tool and information service only, similar to books, courses, or reference materials.

WE HAVE ZERO LIABILITY FOR:

  • How you use the information provided
  • Outcomes from using the tracking tools
  • Results from applying educational content
  • Any health decisions or actions you take
  • Any interpretation of your tracked data
  • Any consequences of using or not using the Service

13. Indemnification

You agree to indemnify, defend, and hold harmless LumeLabs OÜ, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your User Content

  • Your breach of applicable laws

These Terms are governed by the laws of Estonia and the European Union, without regard to conflict of law provisions.

16.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.
